Dr. Sunil Aggarwal's petition to move psilocybin from Schedule I to Schedule II under the Controlled Substances Act — first filed in February 2022 — has been sitting at the Department of Health and Human Services since the DEA forwarded it there for scientific review on Aug 11, 2025. Fourteen months later, per Marijuana Moment, HHS still hasn't responded, and no timeline has been disclosed. Attorney Kathryn Tucker, representing Aggarwal, argues the DEA should "promptly move forward" in light of Trump's psychedelics executive order — but as of this writing, the order hasn't translated into movement on the one rescheduling petition actually working its way through the federal process.
